40,000 Companies Vote Starting Sunday — and AI Is on the Agenda for the First Time
On March 1, the 2026 works council elections begin in Germany. Over 40,000 establishments will elect new works councils through May. This happens every four years. What's different this time: AI is on the agenda as a central issue for the first time. The DGB, IG Metall, and ver.di are making it a campaign topic — alongside remote work and data protection.

Three Laws, One Deadline
The legal situation is more concrete than many think:
Layer 1 — BetrVG (effective now): Since the Works Councils Modernization Act 2021, "Artificial Intelligence" is an independent concept in German works council law. Section 80(3) gives every works council the right to bring in an external AI expert — the necessity is legally presumed for AI. The employer cannot refuse. And the employer pays.
Layer 2 — EU AI Act Art. 26(7) (from August 2, 2026): Anyone deploying a high-risk AI system in the workplace — including recruiting, performance monitoring, task allocation, promotion and termination decisions — must inform and consult the works council beforehand.
Layer 3 — KI-MIG (in legislative process): Germany's implementing law was approved by the Cabinet on February 11, 2026. The BNetzA becomes the central supervisory authority. Enforcement lags — but the substantive obligations apply regardless.
The math: New works councils are elected between March and May. Three to five months later, the EU deadline hits. This means: works councils taking office in spring must co-determine AI deployments in summer — often with zero prior experience.
The Gap Nobody Talks About
A Weizenbaum Institute study (2024, n=609 — 385 managers, 224 works council members) shows: roughly half of companies don't adequately involve the works council in AI implementations. The authors explicitly recommend external expertise and training for works councils.
Meanwhile, Bitkom (2026, n=604) reports: 36% of German companies are actively using AI — double the previous year. And 31% cite lack of employee acceptance as a central barrier.
This is no coincidence. Where co-determination isn't structured, distrust emerges. And distrust is the most expensive obstacle to AI adoption.
What Works: Structured Dialogue Instead of Confrontation
The Haufe Personalmagazin (3/2026) puts it succinctly: companies are "more than ever dependent on cooperation with their works councils." The confrontational approach to AI co-determination is "generally not advisable."
The key point: This isn't about works councils blocking AI. It's about structured co-determination accelerating AI adoption — because it creates acceptance before resistance emerges.
Companies that understand this now will have a regulatory advantage from August. Those that don't will be forced by their own works council — and then it gets more expensive.
